Common Questions About Auto Salvage Yards

Here are seven common questions about junkyards like Carter’s Auto Salvage, answered with factual details from Pennsylvania regulations and operational standards:

1. What Licensing and Regulatory Requirements Apply?

Junkyards like Carter’s Auto Salvage must obtain licenses from PennDOT to operate near highways, per the Federal Highway Beautification Act. Facilities must ensure “adequate screening” to prevent visibility from roadways, with requirements enforced through state laws (Act No. 4, 1966) and Pennsylvania Code Title 67, Chapter 451. Licensing also mandates compliance with federal regulations (23 U.S.C. §136 and 23 CFR Part 751).

2. What Items Can They Legally Sell/Store?

Junkyards are defined as facilities storing ten or more junked vehicles or scrap metal. They can also handle wrecked vehicles, engines, transmissions, and other automotive parts. The term excludes non-automotive scrap (e.g., appliances) unless explicitly permitted.

3. What Screening/Fencing Rules Exist?

Junkyards must install chain-link security fencing at least 8 feet tall around operational areas. Gates must remain locked off-hours, and no advertising is allowed on fences. In urban areas like Chester, screening may include landscaped setbacks of 20 feet from public roads.

4. How Are Operations Structured?

  • Storage Limits: Junk piles ≤8 feet tall within 50 feet of screening and ≤12 feet elsewhere.
  • Prohibited Activities: Burning tires/gasoline, storing flammable waste, or using premises as a public landfill.
  • Fire Safety: Easy access for firefighting within storage areas.

5. What Zoning Restrictions Apply?

Junkyards must front public roads and occupy 10–20 acres. Premises not approved in licensing cannot be used for operations. Setbacks from streets may exceed 20 feet in municipally zoned areas.

6. How Are Inspections Conducted?

Municipal or state-appointed inspectors can enter premises “at any reasonable time” to verify compliance with fencing, storage, and waste management rules. Violations risk license revocation.

7. What Environmental/Local Laws Apply?

Facilities cannot burn any materials, including oil, tires, or petroleum products. Combustible waste unrelated to business operations is strictly prohibited. Premises must avoid fire hazards and maintain good repair.

My truck was driving erratic, I thought it was the fuel filter. I called Chester and he agreed to replace the filter. 1 day later guy charges me $800 for spark plugs, wires, fuel filter and diagnostics none of which I agreed to I said I only need a fuel filter. He never had me sign a consent form to work on my truck and left myself and father at his shop for 8 hrs in the hot sun while he continously left for unexplained reasons. I have NEVER been so blatantly ripped off in my life. Do not bring our vehicle here.
